Art law and advisory firm, Guest Work Agency (GWA) has advised the Ballarat International Foto Biennale on the entry terms and conditions for their inaugural Prompted Peculiar – International AI Prize. Ballarat International Foto Biennale is Australia’s most prestigious photographic festival, held in the historic town of Ballarat spanning over 60-days from August to October.

PROMPTED PECULIAR – AN INTERNATIONAL PRIZE FOR AI GENERATED ART

Prompted Peculiar is a new international prize which aims to bring artists and audiences into the evolving world of images created using artificial intelligence.

Prompted Peculiar is an invitation to debate where this new art of ‘promtography’ belongs. The term ‘promptography’ was coined this year when photographer Boris Eldagsen turned down first prize in the creative open category of the Sony World Photography Awards this year, because his image ‘The Electrician’ was generated by AI, and in his words, was ‘not photography.’

Prompted Peculiar offers an AUD $2000 award for the overall winner and AUD $1000 for the People’s Choice award. Finalists will be selected by an international judging panel which includes AI artist Boris Eldagson, Artlink Magazine’s Megan Rainey and Ballarat International Foto Biennale CEO Vanessa Gerrans.

The Prompted Peculiar exhibition will be on view from 22 September–22 October, 10am–5pm daily at BAaD Gallery & Events, 737 Sturt Street in Ballarat. Entries are now open.

LEGAL ADVICE FOR BALLARAT INTERNATIONAL FOTO BIENNALE

GWA advised the Ballarat International Foto Biennale on the terms and conditions of entry for Prompted Peculiar. The terms and conditions explain, amongst other elements, the intellectual property, moral rights and the indigenous cultural and intellectual property (ICIP) considerations of exhibition and promotion of finalist entries, and the conditions on which generative AI tools can be used as part of the creation process.

GWA has particular expertise in advising on legal issues relating to the use of advanced technologies in creative projects, such as AI, blockchain, VR, AR and XR.

Director and Founder of GWA, Alana Kushnir, says, “With the use of technology evolving so rapidly in the creative sphere, we were thrilled to be able to provide practical, reassuring advice to the Ballarat International Foto Biennale on its innovative program.”
